General terms and conditions
The Guru e.U. (IT guru)
- General / scope / contractual relationship
1.1. The Guru e.U. (IT guru) (in a row "IT guru“Mentioned) is a company registered in the commercial register under the FN458747D based in 1100 Vienna, Karl-Popper-Strasse 22.
It primarily provides entrepreneurs (in a row "User“) On your internet platform modules with different service products from IT guru selected and tested third-party entrepreneurs (=“Offerer“) Ready that the user can book. 1.2. For contracts between the IT guru and the user, the following conditions are only considered to be the contractual partner. The user expressly agrees with these conditions before registration and any order on the platform of the IT guru. With successful registration on the platform, the user's approval is also completed.
There are no deviating or supplementary agreements and are necessary for those expressly written consent of the IT guru.
If the user does not agree with these conditions and technical requirements, he is prohibited from participating in the platform of the IT guru.
- Requirements / account
2.1. In order to enable the user to use or participate in the platform, the user is obliged to set up a free account with an individual user profile on the website of the IT guru.
2.2. This account must be set up with truthful, testable information. For account registration, EDV guru must be announced certain personal data, such as the first and surname, date of birth, a telephone number and an email address. The user has to ensure that his account data is and will remain correct, complete and up -to -date.
2.3. The user is obliged to keep his password secret. The user is liable for damage caused by poor confidentiality of the password by the user or by inadmissible transfer to third parties.
A transfer to third parties for the use of the account is not permitted; Likewise, a assignment or transfer of this in this regard, of whatever kind, to third parties. The user is responsible for all activities on his account. The user undertakes to comply with all relevant laws. Participation in the platform can only be made for lawful purposes.
- Availability
There is no entitlement to the availability of the service or the applications of the IT guru. The user is aware that there is no guarantee on the Internet for the goal achievement of his data. Such a guarantee is in no way adopted by the IT guru. The IT guru is not liable for failures or for the non-availability of the platform, its services or applications, or its consequences. Under no circumstances is the IT guru liable for supernatural influences, technical problems of third-party providers and other influences that are not directly related to the servers of the IT guru.
- Technical responsibility
4.1. The IT guru ensures that if possible, the technical platform on the Internet is protected from unauthorized attacks ("hackers"). The user notes that despite careful planning and technical execution, absolute protection is not possible on the Internet. The IT guru is only liable to the user for intentional and grossly negligent violation of their contractual obligations in accordance with the following provisions. In any case, liability for slight negligence is excluded. These liability restrictions do not apply to consumers in accordance with Section 6 (1) 9 of the KSchG.
Any liability of the IT guru is limited to typically predictable damage to the user. The IT guru is by no means liable for lost profit, consequential damage, indirect and indirect damage as well as pure financial damage of all kinds.
4.2. If the IT-GURU acts as an intermediary, so there is no liability in this regard, neither to the user nor to the provider.
- Violations / lock
In principle, all violations of the terms of use are classified as violations. The IT guru reserves the right to block immediate blocking in the event of a violation of the terms of use or the legal situation on the part of the user.
- manipulation
Any intentional manipulation and/or deception to circumvent the control and protective mechanisms of the IT guru lead to the immediate blocking of the account. The IT guru is not liable for failure and consequential damage.
- data protection
The user expressly agrees to the processing and storage of his data by the EDP-Guru and is entitled to cancel this consent at any time. All data provided on the part of the user only serve internal purposes. For further order processing, the IT guru provides the information or data provided by the user to the provider associated with the module for order to process the order and direct contact. Other third parties are not included in this further gait law.
The orders and transactions made on or through the platform are recorded and evaluated by the IT guru digitally.
Both the user and the provider are aware of the fact that the IT guru processes data even if it is mere intermediaries.
- Digital communication
By registering an account on the website of the IT guru, the user agrees to email traffic or communication via digital networks or channels.
- Modules / business completion / resignation / termination
9.1. On the platform EDV-Guru, entrepreneurs offer their services and products primarily useful for entrepreneurs & private users to the user. The user is informed about various services and products and can get in touch with an entrepreneur for the purpose of graduation via direct booking of the modules or via the specified contact options. With the booking and the payment made, the contract is concluded with the respective provider. It is pointed out that for professional reasons, the providers may work with their own terms and conditions, which are available separately before booking.
9.2. With regard to the services provided directly by the IT guru, the contract is concluded after booking and payment made only by a confirmation email on the part of the IT guru.
9.3. The user has the possibility of a "subscription" for the above services or products for a certain period of time with a certain minimum term. In the event of a subscription to be completed, a certain down payment can be requested by the user. The remaining subscription price must then be paid by the user in monthly partial amounts.
9.4. The "subscription" is limited to a minimum term and is automatically extended by this minimum term, provided that it is not terminated in writing three months before the time of the time before the time of the time.
9.5. If the user is a consumer, he is nevertheless not entitled to withdraw from the contract concluded in the distance sales in accordance with Section 18 Paragraph 1 Z 1 FAGG, provided that on the basis of an express request of the consumer in accordance with Section 10 FAGG and a confirmation of the consumer on his knowledge of the loss of the right of withdrawal If the contract was fully fulfilled - before the expiry of the withdrawal period according to § 11 FAGG, the performance of the service had started and the service was then fully provided.
- Payment processing and payment
10.1. The payment of the services booked by EDV-Guru as a contractual partner and as an intermediary is generally made by a pre-cash. Payment using a credit card, ATM, SEPA direct debit, Sofortüberweisung, PayPal or Apple Pay are currently available as payment methods.
In “Subscription” only the payment methods credit card or debit card are available.
10.2. If the user gets into default in the event of a "subscription" with just a monthly partial payment ("rate"), the total amount is immediately due (loss of appointment).
10.3. In the event of a default of payment, albeit, if so, the EDP-Guru is entitled to be 4 % p.a. for consumers and entrepreneurial interest p.a. If the payment is qualified, the user undertakes to replace the IT guru all dunning and collection expenses.
- Exclusion and restrictions on liability
In the absence of participation, the IT guru is in no way liable for the business, their final or non-conclusion between the users and the provider, the respective transactions and their consequences, which are in direct or indirect connection from the participation in the platform or in contact with Users from the platform stood or stand, enter or be able to enter. In those cases in which the EDP-GURU becomes a contractual partner, the IT guru is liable to the user (as a contractual partner) only for intentional and grossly negligent violation of their contractual obligations. In any case, liability for slight negligence is excluded in all cases. Liability is limited up to the amount of the order amount. These liability restrictions do not apply to consumers in accordance with section 6 (1) of the KSchG.

- Retention of title
If the IT-GURU products are delivered, they remain in the sole ownership of the IT guru until full payment.
- General provisions
13.1. The user must not transfer the rights and obligations resulting from the personal account.
13.2. For the legal relationship between the EDP guru and the user as well as between the user and the provider, as well as for these conditions, exclusively Austrian laws are applied to the exclusion of the UN sales law and collision law.
13.3. Against claims of the IT guru, the user can only offset or claim a right of retention if the counterclaim of the IT guru is undisputed and final. This provision does not apply to consumers in accordance with §§ 6 Paragraph 1 Z 7, 8 KSchG IVM § 1438 IVM Section 471 ABGB.
13.4. The IT guru expressly reserves the right to change its general terms and conditions one-sided. In this case, the user is informed in writing about the changes to the terms and conditions and can object to this change within 14 days. In the event of an objection, a special right to terminate the EDP guru is considered agreed.
13.5. For all disputes that arise from the legal relationship between the IT guru and the user as well as between the user and the provider, from the services offered or these conditions or are related to the same, including questions about its validity, interpretation and enforceability The factual court in Vienna exclusively responsible. This provision does not apply to consumers.

In the event of a contract, all data from the contractual relationship will be saved by the end of the tax law retention period (7 years). The data name, address, purchased goods and purchase date are also saved until the product liability has expired (10 years). Data processing is based on the legal provisions
of Section 96 (3) TKG as well as Art 6 Paragraph 1 Lit A (consent) and/or lit B (necessary to fulfill the contract) of the GDPR.
3. Credit check and scoring
